Terms & Conditions
These are the terms and conditions that apply to all sales and upon which orders to Harbour Wines Holding Limited are accepted unless notified in writing.
PLEASE READ THESE TERMS AND CONDITIONS CAREFULLY AND THAT YOU ACCEPT AND AGREE TO BE BOUND BY THEM.
1. Definitions:
In these Terms and Conditions:
“The Company” means Harbour Wines Holding Limited;
“Customer” means any Private Customer or Trade Customer as the case may be;
“Goods” means the products and services to be supplied by Harbour Wines Holding Limited to the Customer;
“Trade Customer” means a Customer who purchases Goods with a view to resale in the ordinary course of its business and/or who Harbour Wines Holding Limited notifies is classified as such.
1. General

The Company may amend these Terms and Conditions from time to time without notice to the Customer in relation to future sales. None of the Company's employees has the right to bind Harbour Wines Holding Limited to any verbal agreement which does not comply with these terms and conditions.

The Company does not sell alcohol to persons under the age of 18. At the time of delivery, the Company or its carrier may request proof of age from the person accepting the delivery.

The description and price of the Goods will be as shown on the Company's website. Every effort is made to ensure that prices shown the Company's website are accurate at the time the Customer place an order. If an error is found, the Company will inform the Customer by phone or email to the address provided in the order form as soon as possible and offer the Customer the option of reconfirming the order at the correct price or cancelling the order. If order is cancelled, the Company will refund the Customer for any sum that has been paid by the Customer for the Goods.

The Goods are subject to availability. If on receipt of the requested goods that the Customer ordered are not available in stock, the Company will inform the Customer as soon as possible by phone or in writing. The Company will refund the Customer for any sum that has been paid by the Customer for the Goods.
1. Purchase Orders

A purchase order placed by the Customer, by whatever means, with the Company:

may not be cancelled without the Company's consent in writing;

may be wholly or partially accepted or rejected by the Company's absolute discretion if there is not a sufficient quantity of Goods available;

if the terms upon which the Goods are available are not acceptable to the Company or for any other reason in its entire discretion.

Acceptance of a purchase order by the Company is not effective until it is confirmed by the Company to the Customer as an invoice.

No contract exists between the Customer and the Company for the sales of any Goods until the Company has received the Customer's order and the Company has accepted the order. The Company's acceptance of the Customer order brings into existence a legally binding contract between the Customer and the Company.
1. Payment Terms

All prices are quoted in HKD.

Payment is due on upon receipt of invoice. The Company accept HKD bank transfer only.

Any fees issued by the issuing or receiving bank with regards to electronic transfers are the responsibility of the Customer.
1. Delivery
-
All deliveries are subject to payment being received before delivery.

All Goods must be signed for on delivery by an adult aged 18 years or over.

The Company can arrange for free delivery of wine purchased for amount over HK$10,000 to a Hong Kong address. An additional delivery charge applies to overseas delivery. The Company will contact the Customer and provide the Customer with a quote.

Delivery within Hong Kong will normally made on the next working day after acceptance of payment for an order. For more urgent deliveries please contact the Company on (852) 3568-9246, 3568-9247 or sales@harbourwines.com.
Cut off time for delivery within Hong Kong on the next working day
Monday to Friday : 3:00pm
Normal delivery hours within Hong Kong
Monday to Friday : 10:00am to 6:00pm
Saturday : 10:00am to 12:30pm

An additional delivery charge will be added on for delivery to Peak, Sai Kung and Discovery Bay
HKD 400 per delivery up to 5 cases plus additional HKD 20 per case thereafter

Delivery will be suspended when typhoon signal No.8 or above or a black rain warming is hoisted. The Company will contact the Customer to re-schedule delivery time.

Deliveries are made by a 3rd carrier and the Company is not responsible for unforeseen changes in their delivery schedule.

If a delivery attempt is made to the provided delivery address and a competent recipient is not present to sign for the goods, the order will be returned to the Company's warehouse. In this instance, a delivery surcharge may need to be paid or no effort is taken by the recipient to contact the courier to arrange re-delivered. The Company will contact the Customer and provide the Customer's with a quote.

The Company shall not be responsible for or liable to any delay in delivery which is outside the Company's control including but not limited to any failure of any failure of any hardware, software and, or any communication links between the Customer and the internet.
1. Under Bond

All the UK wines are held in a bonded warehouse. Prices are quoted sold in bond price excluding UK Duty and VAT. Bond delivery can only be arranged to any UK bonded warehouse.

Wines can only be held and/or sold/resold under bond.
1. Title and Risk

Risk of loss or damage to Goods shall pass to the Customer when the Goods are physically delivered to or collected by, either the Customer or an agent acting on behalf of the Customer.
1. Breakages and Shortfall

It is the responsibility of the Customer to examine the goods immediately upon collection or delivery or any deficiencies and/or damages. Claims(if any) must be lodged with the Company at the time of delivery, otherwise any breakages and shortfall will be considered to have occurred after collection or delivery and will not be compensated.
1.Wine Broking

Customers who would like to sell their wines through the Company can do so with prior agreement with the Company. Contact the Company on (852) 3568-9247, 3568-9246 or sales@harbourwines.com
1. Storage

The Company reserves the rights to charge a storage fee for wines which have been sold to the Customer, but have not been collected or delivered within 30days of purchase.
1.Return of Goods

The Company shall make every effort to assess the condition of any wine it sells, and to the Company’s knowledge, the wine is what its label describes it to be. As wine by its nature is subject to change in bottle over time, the Customer must make reasonable allowances for natural variation that occur in relation to – but not limited to – conditions of the cases, labels and corks for more mature, aged wines. The Company does not accept returns of wine purchased from Harbour Wines Holding Limited for any reasons, including corked wines unless notified on delivery.

If the Customer is not satisfied with the goods he purchases from the Company, or if the Company makes an error with the Customer's order, the Customer must contact the Company at (852) 3568-9246 or 3568-9247 or email sales@harbourwines.com immediately on delivery.
